Ponder — Terms of Service
Welcome to Ponder, also styled "ponder*" (the "App"). These Terms of Service ("Terms") are a legal agreement between you and the individual operator of Ponder ("Ponder," "we," "us," or "our"). Please read them carefully. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
Ponder is an independent, fan-made application for organizing and tracking in-person Magic: The Gathering games and events. Ponder is not produced, endorsed, sponsored, or affiliated with Wizards of the Coast LLC or Hasbro, Inc.
1. Eligibility
You must be 18 years of age or older to create an account or use the App. By using Ponder, you represent and warrant that you are at least 18 years old, that the date of birth you provide at signup is accurate, and that you have the legal capacity to enter into these Terms. If we learn that a user is under 18, we may suspend or delete the account.
2. Your Account
To use most features of Ponder, you must create an account using a valid email address and date of birth. You are responsible for:
- Providing accurate information when registering.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
You agree to notify us promptly at support@pondertheapp.com if you suspect any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
You may deactivate your account temporarily or delete it permanently at any time from within the App. Deleting your account removes your personal data as described in our Privacy Policy; certain shared records (such as your username in match history other players rely on) may persist as described there.
3. What Ponder Does
Ponder helps you host and join in-person drafts and other Magic: The Gathering events, run Swiss-style pairings, record match results, log games, and track statistics, trophies, and history. Ponder is a record-keeping and organizing tool only. It does not sell, distribute, or facilitate the sale of Magic: The Gathering cards or products, and it does not host actual gameplay.
4. User Content
Ponder lets you create and upload content, including your username, display name, profile bio, pronouns, location, event titles, notes, and deck images ("User Content").
You own your User Content. By posting it, you grant Ponder a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely for the purpose of operating and improving the App (for example, showing your deck image to other players in an event you joined, or displaying your username in search results and standings).
You are solely responsible for your User Content and represent that you have the rights necessary to post it. You agree not to upload content that:
- Is unlawful, defamatory, harassing, threatening, hateful, or obscene.
- Infringes anyone's intellectual property, privacy, or other rights.
- Contains malware, spam, or attempts to compromise the App or other users.
- Impersonates another person or misrepresents your affiliation with anyone.
Zero tolerance. Ponder has no tolerance for objectionable content or abusive users. We review reports promptly, remove content that violates these Terms, and ban users who post it or who harass others.
We may remove any User Content and suspend or terminate accounts that violate these Terms, at our discretion and without notice. You can report User Content or another user's conduct to us at support@pondertheapp.com or through the in-app report feature, and you can block other users at any time.
5. Acceptable Use
When using Ponder, you agree not to:
- Use the App for any illegal purpose or in violation of these Terms.
- Harass, abuse, threaten, or defraud other users.
- Attempt to access accounts, data, or systems you are not authorized to access.
- Reverse engineer, scrape, overload, disrupt, or interfere with the App or its servers.
- Use automated means to access the App except as expressly permitted.
- Create accounts to evade a suspension or ban.
6. Events, Results, and Records
Ponder relies on users to host events and report accurate results. We do not verify, referee, or guarantee the accuracy of any pairings, match results, standings, trophies, or statistics recorded in the App. Disputes about in-person games, results, or conduct at an event are between the players and event host involved. Ponder is not responsible for resolving them and is not a party to any event.
You are responsible for your own conduct and safety at any in-person gathering you organize or attend through the App. Ponder does not screen users and makes no representations about anyone you may meet or play with.
7. Intellectual Property
Ponder's property. The App, including its design, code, branding, logos, and original graphics (excluding User Content and third-party marks), is owned by the operator of Ponder and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal, non-commercial purpose. You may not copy, modify, distribute, sell, or create derivative works from the App without permission.
Third-party property. Magic: The Gathering, including card names, set names, mana symbols, and related imagery, is the intellectual property of Wizards of the Coast LLC. Ponder is an unofficial fan tool and claims no ownership over, and asserts no affiliation with, Wizards of the Coast or Hasbro. All such marks belong to their respective owners.
8. Third-Party Services
Ponder relies on third-party services (including cloud hosting, database, and email providers) to operate. The App also displays card data from Scryfall and lets you import decks and cubes from services such as Moxfield, Archidekt, and CubeCobra. Your use of the App is also subject to those providers' terms where applicable. We are not responsible for the content, accuracy, acts, omissions, or availability of third-party services.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, secure, or that any data (including results, standings, or uploaded images) will be preserved without loss. Ponder is provided free of charge, is under active development, and features may change or be removed at any time.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PONDER OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Ponder and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your User Content, your use of the App, your conduct at any event, or your violation of these Terms or the rights of any third party.
12. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will survive.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and International Users
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the App will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their personal jurisdiction and venue.
Ponder is operated from the United States. If you access the App from outside the United States, you do so on your own initiative and are responsible for complying with all laws that apply to you in your location. By using the App, you consent to the transfer, storage, and processing of your information in the United States, which may have data-protection laws different from those in your country.
15. Apple App Store Terms
If you downloaded Ponder from the Apple App Store, you also agree to the following:
- These Terms are between you and Ponder only, not Apple Inc. ("Apple"). Ponder, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Ponder, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the App or your use of it infringes their intellectual property rights, Ponder, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
